01Agreement
These Terms of Service (“Terms”) apply to your use of the Hayyat Marketing website and to any enquiry, proposal, or project you begin with us. By using this site, submitting a form, or accepting a proposal, you agree to these Terms.
If you are using the site or buying services on behalf of a company, you confirm that you have authority to bind that company.
A signed proposal, statement of work, or invoice may add project-specific terms. Where those documents conflict with this page, the signed project documents take priority for that work.
02Who we are
Hayyat Marketing is a digital marketing agency offering SEO, social media marketing, web development, graphic design, and video editing.
03Use of this website
You may browse this website for lawful, professional purposes. You agree not to:
- Misuse forms, attempt to break security, or overload the site.
- Copy, scrape, or republish our content, case studies, or branding without permission.
- Submit false, harmful, or infringing information.
We may update, pause, or remove website content at any time. We do not guarantee that the site will always be available or error-free.
04Services and proposals
Information on this website is general. It is not a binding offer. Scope, timeline, deliverables, and fees are confirmed only in a written proposal, email confirmation, or contract.
Marketing, SEO, advertising, and creative work depend on platforms, competition, and audience behaviour. We do not guarantee specific rankings, follower counts, traffic, leads, or revenue unless a signed document clearly states otherwise.
05Your responsibilities
To deliver work properly, you agree to:
- Provide timely access to accounts, content, brand assets, and feedback.
- Ensure you have rights to materials you send us (logos, photos, video, copy, and data).
- Review and approve work within the timelines we agree.
- Keep login credentials secure and tell us if access should be revoked.
Delays in feedback, payments, or access may extend timelines. We are not responsible for lost time caused by missing information or late approvals.
06Fees and payment
Fees are set out in the relevant proposal or invoice. Unless we agree otherwise in writing, invoices are due on the stated date. Work may pause if invoices remain unpaid.
Media spend, software licences, stock assets, domain, hosting, and similar third-party costs are extra unless the proposal says they are included. Those costs are charged at the amount billed by the provider, or as quoted by us.
Refunds are handled according to the signed proposal. Discovery, strategy, and completed creative work are generally non-refundable once delivered.
07Intellectual property
We retain ownership of our pre-existing methods, templates, code libraries, and internal tools. Final deliverables created uniquely for you are licensed or assigned as stated in your proposal.
Until invoices for a project are paid in full, we may withhold final files or restrict use of unpaid work. You grant us a licence to use approved work in our portfolio, website, and proposals unless you ask us in writing not to.
You remain responsible for claims arising from content you provide. We remain responsible for original work we create, excluding materials you supplied or third-party tools we use at your request.
08Third-party platforms
Campaigns and websites often rely on third parties such as Meta, Google, hosting providers, analytics tools, and stock libraries. Those services have their own terms and availability.
We are not responsible for outages, policy changes, account suspensions, or algorithm updates outside our control. Recommended platform spend is your decision unless we are contracted to manage it within an agreed budget.
09Liability and termination
To the fullest extent permitted by law, Hayyat Marketing is not liable for indirect, incidental, or consequential losses, including lost profits, data, or goodwill.
Our total liability for a project is limited to the fees you paid us for that project in the three months before the claim.
Either party may end an ongoing retainer with written notice as set out in the proposal, or immediately for material breach that is not remedied. You remain responsible for fees for work already performed and non-cancellable third-party costs.
10Governing law
These Terms are governed by the laws of Pakistan. Courts in Lahore have exclusive jurisdiction, except where applicable law requires otherwise.
We may update these Terms from time to time. The “Last updated” date at the top of this page shows the current version. Continued use of the website after a change means you accept the revised Terms.
